How are rewards distributed in a mass tort claim?

The facts of each plaintiff’s case are evaluated based on factors like causation, injuries, and damages. When a settlement offer manifests, each plaintiff decides if they want to accept the offer. The settlement is not split amongst the individual plaintiffs. 

This distribution of compensation differs from that of a class action lawsuit. The defendant may offer a large settlement in class actions, but the amount is shared equally among all the class members. 

Because mass tort cases weigh each plaintiff’s case and circumstances individually, this type of legal action tends to reward plaintiffs more fairly, according to their respective damages.
